The Miami Township Zoning Commission met on Thursday, January 8,
2004 and considered and took action on the following:
[Case 492] The applicants,
John Hueber and Mary Harris, requested a zone change from R-1 Single
Family to B-1
Neighborhood Business for the purpose of constructing an office
building and fitness center. This case
was continued from the December meeting in order to deal with the
issues of including an adjoining
property into the request, finalizing access issues with ODOT and
finalizing on-site waste water treatment
issues. Given, there were still outstanding issues this case was
continued until the February meeting.
[Case 493] The applicant,
Vineyard Church, requested a zone change from R-2 Single Family to B-1
Neighborhood
Business for a church located at 5857 Highview Drive. The zone change
would allow for the operation of a
church and the expansion of the physical building on the property.
After the completion of the public
hearing, the Zoning Commission voted to recommend to the Trustees that
the zone change be approved.
(Note – On Tuesday February 24, 2004 the Board of Trustees voted to
approve the zone change request)
[Case 494] The applicant,
Roberts Engineering, on behalf of Izzi Home Improvement, requested a
zone change from
R-1 Single Family to B-2 General Business for property located at 1081
SR 131. The purpose of the zone
change was to locate the Home Improvement Business on this property.
The applicant withdrew the
application and the Commission took no action.
[Case 495] The applicant,
Wolfpen Farms, proposed several zone changes for property located at
the intersection of
US 50 and Wolfpen Pleasant Hill Road. The request was to rezone 10
acres of “A” Agriculture to “I”
Industrial and to rezone 73 acres of “A” Agriculture to R-3
Multi-family with a R-PUD Overlay. The purpose
of the rezoning proposal was to develop a mixed-use project with
retail, light industry and condominiums.
After the completion of the public hearing the Zoning Commission voted
to recommend to the Trustees the
zone change request be approved. (Note- on February 24, 2004 the Board
of Trustees voted to approve the
zone change request)
The Miami Township Zoning Commission met on Thursday, February 5, 2004
and considered and took action on the following:
[Case 492] The applicants,
John Hueber and Mary Harris, requested a zone change from R-1 Single
Family to B-1
Neighborhood Business for the purpose of constructing an office
building and fitness center. This case
was continued from the January meeting in order to deal with the
issues of including an adjoining property
into the request, finalizing access issues with ODOT and finalizing

The issue of access was still not resolved with ODOT and the case was
continued to the March meeting.
[Case 496] The applicant,
Richard Herzog, requested a zone change for a portion of his property
located at 1192 SR
28 from R-2 Single Family to B-2 General Business. This is the site of
Putt-N-Fun. The purpose of the
zone change request was to redevelop some of the site by removing some
attractions, adding an indoor
family fun center and rebuilding a portion of the miniature golf
course. After the completion of the public
hearing, the Zoning Commission voted to recommend to the Trustees the
zone change request be
approved. (Note- on March 16, 2004 the Board of Trustees voted to
approve the zone change request)
The Miami Township Zoning Commission met on Thursday, March 4, 2004
and considered and took action on the following:
[Case 492] The applicants,
John Hueber and Mary Harris, requested a zone change from R-1 Single
Family to B-1
Neighborhood Business for the purpose of constructing an office
building and fitness center. This case
was continued from the February meeting in order to deal with the
issues of including an adjoining
property into the request, finalizing access issues with ODOT and

issues. The applicant addressed all outstanding issues. (Note- The
Trustees voted to approve the request
on April 7, 2004)
[Case 497] The applicant, S
& S Development, requested a zone change for property located on
Branch Hill Guinea
Pike approximately 1000 feet north of Loveland Miamiville Road from
R-1 Single Family to B-1
Neighborhood Business with a Planned Business Development Overlay. The
purpose of the request was
to build 30 condominium units in six buildings. A number of issues
were discussed during the public
hearing. The Zoning Commission vote on the rezoning ended in a tie. On
March 22, 2004, the Zoning
Commission met again to deliberate this request. At the end of the
deliberations the Zoning Commission
voted to recommend the Trustees approve the zone change request.
(Note- The Trustees voted to approve
the request on April 21, 2004)
[Case 498] The applicant,
Roberts Engineering, on behalf of Izzi Home Improvement, requested a
zone change from
R-1 Single Family to B-2 General Business for the purpose of
constructing three office/warehouse
buildings. The application was modified to include a Planned Business
Development Overlay. After some
discussion, the Zoning Commission voted to recommend to the Trustees
the zone change be approved. .
(Note- The Trustees voted to deny the request on April 7, 2004)
The Miami Township Zoning Commission met on Thursday, April 1, 2004
and considered the following:
During a work session the Zoning Commission discussed urban design
guidelines for the B-1 Neighborhood Business district and the B-2
General Business District. These guidelines include standards for
building design, building materials, pedestrian access, parking and
landscaping.
The Miami Township Zoning Commission met on Thursday, May 6, 2004 and
considered and took action on the following:
[Case 499] This case is a
text amendment to the B-1 Neighborhood Business District, the B-2
General Business
District and the Off-street Parking regulations. The text amendment
provides standards for building design,
building construction material, pedestrian access, parking and
landscaping. After some discussion, the
Zoning Commission voted to recommend to the Trustees approval of the
text amendment. (Note – On
June 1 the Board of Trustees voted to approve the text amendment with
one modification that limited
building size in the B-1 Neighborhood Business District to 20,000
square feet)
The Miami Township Zoning Commission met on Thursday, June 3, 2004 and
considered and took action on the following:
There were no public hearings in June. The Zoning Commission discussed
the conditional use sections of the B-1 and B-2 Business Districts.
Discussion of the conditional uses was continued to the July meeting.
The Miami Township Zoning Commission met on Thursday, July 1, 2004 and
considered and took action on the following:
There were no public hearings in July. The Zoning Commission continued
its discussion of the conditional use sections of the B-1 and B-2
Business Districts. With the proposed revisions complete, the text
amendment was set for public hearing on August 5.
The Miami Township Zoning Commission met on Thursday, August 5, 2004
and considered and took action on the following:
[Case 500] The applicant,
Roberts Engineering, representing Mr. Thomas Haines, requested a zone
change from R-2
Single Family Residence to B-2 General Business for the purpose of
establishing a youth golf training
facility. The property is located at 5914 Wolfpen Pleasant Hill Road.
The property is bordered by business
zoning on two sides and Bypass 28 on the remaining sides. One of the
primary concerns was netting that
would prevent balls from being hit onto Bypass 28. After some
discussion the Zoning Commission
recommended the request be approve conditioned upon the planting of
landscaping on the outside of the
netting. On September 7 the Board of Trustees concurred with the
Zoning Commission and approved the
request.
[Case 501] This text
amendment revised the conditional uses sections of the B-1 and B-2
business districts. The
purpose of the revisions is to provide clarity to the conditions
associated with each conditional use. The
conditional uses include, day care centers, outdoor and indoor
commercial recreation facilities, and
nursing homes. Self-storage facilities were deleted from the B-1
Neighborhood Business District.
Contractor Shops and yards were deleted from the B-2 General Business
District and placed in the I
Industrial district. After some discussion the Zoning Commission
recommended the Text amendment be
approved. On September 7 the Board of Trustees held its public hearing
on the amendment. At the
request of a resident, who needed more time to review the application,
the Trustees continued the hearing
until September 21.
The Miami Township Zoning Commission did not meet in September.
The Miami Township Zoning Commission met on Thursday, October 7, 2004
and considered and took action on the following:
There were no public hearings in October. The Zoning Commission
discussed the urban design standards and sign standards. This
discussion will be continued at the November 4 meeting.
The Miami Township Zoning Commission met on Thursday, November 4, 2004
and considered and took action on the following:
[Case 502] The applicant,
John Donohoo, requested to rezone 3.4 acres from R-2 Single Family
Residential and B-1
Neighborhood Business to B-2 General Business for the purpose of
operating a construction business.
The property is located at 5897 Wolfpen Pleasant Hill Road. The Zoning
Commission discussed the
status of the business as a permitted use or non-conforming use and
the most appropriate zoning district
for the site. The Zoning Commission recommended the Trustees approve a
zone change to “B-1” and
further instructed the Community Development Director to obtain a
legal opinion on the status of the
existing business.
[Case 503] The applicant,
Potterhill Homes, requested to rezone 55.7 acres from R-3 Multi-family
to R-PUD Planned
Unit Development. The proposal is to develop a traditional
neighborhood community with 149 single-family
homes and 54 townhomes with a gross density of 3.65 units per acre.
There was some discussion on the
issue of public vs. private alleys and discussion on the percent of
multi-family units in the development.
The Zoning Commission continued the case until the December meeting to
provide the applicant time to
revise the plan.
Worksession: The Zoning Commission continued its discussion on urban
design standards. No action was taken on this issue.
The Miami Township Zoning Commission met on Thursday, December 2, 2004
and considered and took action on the following:
[Case 503] This case was
continued from the November meeting in order to address the issues of
public vs. private
alleys and the percent of multi-family units in the development. The
applicant revised the plan to reduce
the number of multi-family units. The issue of public alley standards
was researched and the Township
found the County Engineer has no construction standard for alleys. A
similar development in a neighboring
Township will include public alleys at 12 feet wide. This standard was
accepted by the County. The
proposal by Potterhill Homes is 16-foot wide alleys. With the two
issues resolved the Zoning Commission
recommended the Trustees approve the zone change request.
[Case 504] The applicant,
IPS Properties, requested to rezone one acre located at 564 Wards
Corner Road from “R-1”
Single Family to “O-1” Professional Office. The purpose of the
rezoning is to construct a 7,700 square foot
professional office building. The primary issue with the continuing
encroachment of commercial/office uses
into a residential area. After a public hearing and listening to the
applicant and the adjoining property
owners, the Zoning Commission recommended to the Trustees the zone
change request be denied.
[Case 505] The applicant,
Joe Kuethe, requested to rezone 1.3 acres located at 5881 Cook Road
from “R-1” Single
Family to “O-1” Professional Office. The purpose of the zone
change request is to reuse the existing
single-family home as a professional office. The primary issue
discussed during the public meeting was
storm water drainage, particularly on the property to the north of the
proposed office use. Staff said they
would work with the property owner, the County Engineer and the County
Building Department to
investigate the drainage issues and determine a solution. After the
public hearing, the Zoning Commission
recommended to the Trustees the zone change request be approved.
Worksession: The Zoning Commission continued its discussion on urban
design standards. No action was taken on this issue.
