RESOLUTION 2003 - 02

The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on January 7, 2003 with the following members present: Mary Makley Wolff, Edwin H. Humphrey and Joseph W. Uecker.

MR. UECKER made a motion to adopt the following Resolution:

RESOLUTION FOR ROAD IMPROVEMENT, DISPENSING WITH THE SECOND READING

WHEREAS, the Board of Trustees has determined that a new public road shall be constructed beginning at Woodspoint Drive and State Route 28 at the east side of Home Depot and follows Pebble Brook Trail and then turns east towards Easley Drive, then south and connect to State Route 28; and

WHEREAS, the Board of Trustees shall hire an independent professional engineer to prepare the necessary surveys, plans, profiles, cross sections, estimates and specifications as are required for the project; and

WHEREAS, the Clermont County Engineer shall review all of the independent professional engineer's plans for improvements and provide the Board of Trustees with comments on those plans within ten working days after receiving them; and

WHEREAS, the Clermont County Engineer shall monitor all of the independent professional engineer's plans for improvements in order to maintain compliance with existing construction standards and thoroughfare plans, and coordinate construction timelines within the county.

NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio by authority of Chapter 504 and Section 5573.01 of the Ohio Revised Code, as follows:

SECTION 1: That a new public road shall be constructed beginning at Woodspoint Drive and State Route 28 at the east side of Home Depot and follows Pebble Brook Trail and then turns east towards Easley Drive, then south and connect to State Route 28.

SECTION 2: That the Board shall hire Woolpert LLP, an independent professional engineer, to prepare the necessary surveys, plans, profiles, cross sections, estimates and specifications as are required for the project.

SECTION 3: That the Township Administrator is hereby authorized to enter into a contract with Woolpert LLC for professional engineering services.

SECTION 4: The Board does hereby dispense with the requirement that this Resolution be read on two separate days, pursuant to Section 504.10 of the Ohio Revised Code, and authorizes the adoption of this Resolution upon its first reading.

SECTION 5: That this Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board and of its Committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.

SECTION 6: This Resolution shall take effect at the earliest period allowed by law.
