RESOLUTION 2003 - 29

The Board of Trustees of Miami Township, June 17, 2003 with the following members present: Mary Makley Wolff, Edwin H. Humphrey and Joseph W. Uecker.

MR. HUMPHREY made a motion to adopt the following Resolution:

RESOLUTION SUPPORTING THE EXCHANGE OF STATE ROUTE 28 AND BY-PASS 28, DISPENSING WITH THE SECOND READING

WHEREAS, it has long been the goal of both the Ohio Department of Transportation and Clermont County to establish, construct and maintain public road networks with the highest levels of safety and efficiencies possible, and

WHEREAS, striving to achieve this goal, Clermont County proposes to exchange By-pass 28 for an approximate equal section of State Route 28; and

WHEREAS, with the roadway exchange complete a 300% reduction in traffic accidents along a portion of State Route 28 may be realized by the State, while ongoing efforts will be made by Clermont County and Miami Township to further reduce accidents by initiating needed safety improvement projects along this troubled corridor; and

WHEREAS, Miami Township recently completed a State Route 28 Redevelopment Plan and the roadway exchange will greatly assist the township in accomplishing the goals and objectives of the plan.

NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio by authority of Chapter 504 of the Ohio Revised Code, as follows:

SECTION 1: That the Miami Township Board of Trustees unanimously supports the exchange of State Route 28 and By-Pass 28.

SECTION 2: That this Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board and of its Committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.

SECTION 3: The Board does hereby dispense with the requirement that this Resolution be read on two separate days, pursuant to Section 504.10 of the Ohio Revised Code, and authorizes the adoption of this Resolution upon its first reading.

SECTION 4: This Resolution shall take effect at the earliest period allowed by law.

First Reading: June 17, 2003
Second Reading: Dispensed with
Effective: July 17, 2003

MR. UECKER seconded the motion to adopt the Resolution. On the roll call being called the vote resulted as follows:
