The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on January 18, 2005 with the following members present: Mary Makley Wolff, Edwin H. Humphrey and Ken Tracy.
MR. TRACY made a motion to adopt the following Resolution:
RESOLUTION DISPOSING OF SURPLUS EQUIPMENT AND AUTHORIZING THE SALE OF SURPLUS EQUIPMENT, DISPENSING WITH THE SECOND READING
WHEREAS, the Board of Trustees ("Board") are empowered by Section 505.10 of the Ohio Revised Code to sell surplus equipment by private sale, without advertisement or public notification, if the fair market value of property to be sold is, in the opinion of the board, two thousand five hundred dollars or less ($2,500.00); and
WHEREAS, the Board has determined that the surplus equipment listed on Exhibit A and incorporated herein is no longer of value and service to Miami Township and has a value of less that two thousand five hundred dollars ($2,500.00); and
WHEREAS, the Board desires to sell the surplus equipment via a private sale.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio by authority of Chapter 504 and Section 505.10 of the Ohio Revised Code, as follows:
SECTION 1: The Board determines that the surplus equipment listed on Exhibit A is no longer of value and service to Miami Township and has a value of less than two thousand five hundred dollars ($2,500.00).
SECTION 2: The Board shall sell the above referenced surplus equipment at a private sale and authorizes the Township Administrator to approve any and all agreements that may be required for this sale.
SECTION 3: The Board does hereby dispense with the requirement that this Resolution be read on two separate days, pursuant to Section 504.10 of the Ohio Revised Code, and authorizes the adoption of this Resolution upon its first reading.
SECTION 4: That this Board hereby finds and determines that all formal
actions relative to the passage of this Resolution were taken in an open meeting
of this Board, and that all deliberations of this Board and of its Committees,
if any, which resulted in formal action, were taken in meetings open to the
public, in full compliance with applicable legal requirements, including Section
121.22 of the Ohio Revised Code.
SECTION 5: This Resolution shall take effect at the earliest period allowed by
law.
First Reading: January 18, 2005
Second Reading: Dispensed with
Effective: February 17, 2005
MR. HUMPHREY seconded the motion to adopt the Resolution. On the roll call being called the vote resulted as follows:
