RESOLUTION 2005 - 20

The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on May 3, 2005 with the following members present: Mary Makley Wolff, Edwin H. Humphrey and Ken Tracy.

MR. TRACY made a motion to adopt the following Resolution:

RESOLUTION AUTHORIZING THE SUBMISSION OF A TRANSPORTATION ENHANCEMENT GRANT, DISPENSING WITH THE SECOND READING

WHEREAS, the Ohio Kentucky Indiana Council of Governments ("OKI") administers the 2004 Urban Area Transportation Enhancement Grant Program, and

WHEREAS, the Miami Township Board of Trustees desires financial assistance from OKI for a grant to fund a sidewalk improvement project in central Miami Township.

NOW, THEREFORE BE IT RESOLVED by the Board of Trustees of Miami Township ("Board"), Clermont County, Ohio by authority of Chapter 504 of the Ohio Revised Code, as follows:

SECTION 1. That the Board approves an application for OKI financial assistance.

SECTION 2. That Larry Fronk, Community Development Director, is hereby authorized and directed to execute and file said application and to provide all information and documentation required to become eligible for possible funding assistance.

SECTION 3. That the board recognizes the cost estimate for the project is $222,017.85.00 and does agree to obligate 20% matching funds for $45,000.00 required to satisfactorily complete the proposed project. The Board further recognizes that pre-construction costs including, but not limited to, engineering, environmental reviews and right-of-way acquisition are the responsibility of the Township. The Township recognizes any potential cost over-runs will be the responsibility of the Township.

SECTION 4. The Board acknowledges that if funding is approved the development and implementation of the project must be in accordance with the policies and guidelines of the Ohio Department of Transportation and the Federal Highway Administration, including, but not limited to the provisions of the National Environmental Policy Act.

SECTION 5. That the Board does agree to provide long-term maintenance of the sidewalk improvement project.

SECTION 6. That this Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board and its Committees, if any, which result in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.

SECTION 7. This Resolution shall take effect at the earliest period allowed by law.

MR. HUMPHREY seconded the motion to adopt the Resolution. On the roll call being called the vote resulted as follows:
