The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on August 2, 2005 with the following members present: Mary Makley Wolff, Edwin H. Humphrey and Ken Tracy.
MR. TRACY made a motion to adopt the following Resolution:
RESOLUTION AMENDING THE MIAMI TOWNSHIP PROPERTY MAINTENANCE CODE
WHEREAS, Section 505.73 of the Ohio Revised Code authorizes a board of township trustees, by resolution, to adopt, by incorporation by reference, administer, and enforce within the unincorporated area of the township an existing structures code pertaining to the repair and continued maintenance of structures and premises of such structures; and
WHEREAS, the Miami Township Board of Trustees ("Board') has adopted "The BOCA National Property Maintenance Code, Fifth Edition, 1996" as published by the Building Officials and Code Administrators International, Inc. as the Miami Township, Clermont County, Ohio Property Maintenance Code (herein "Code") for the control of buildings and structures as authorized by Resolution 99-36; and
WHEREAS, this Board desires to amend or delete certain provisions of the Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio, by authority of Chapter 504 and Section 505.73 of the Ohio Revised Code as follows:
SECTION 1. That this Board does hereby amend and revise the Code and said amendments and revisions are described in Exhibit A and attached hereto.
SECTION 2. That the Township Clerk shall provide notice of the deletions or amendments to the Code as specified in Section 505.73 of the Ohio Revised Code.
SECTION 3. That this Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board and of its Committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.
SECTION 4: This Resolution shall take effect at the earliest period allowed by law.

MR.HUMPHREY seconded the motion to adopt the Resolution. On the roll call being called the vote resulted as follows:

EXHIBIT A
Amend Section PM 306 by adding the following language:
PM-306.3.3 Construction Dumpsters: All rubbish and debris associated with or resulting from the construction of either residential or commercial structures shall be contained on the construction site in a stable and secure enclosure large enough to accommodate the size of the site. The enclosure must be placed on the construction site and shall not be placed on any street. The permit holder shall maintain the enclosure and site so as to control rubbish and debris at all times, and will remove and dispose of debris in an approved landfill. The enclosure shall be removed from the site within ten (10) days of the issuance of an occupancy permit or within ten (10) days of cessation of active construction work.
