The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on May 18, 2004 with the following members present: Ken Tracy and Mary Makley Wolff.
MRS. WOLFF made a motion to adopt the following Resolution:
RESOLUTION SUPPORTING THE VACATING OF A SECTION OF CATHERINE ALLEY (T-1131), DISPENSING WITH THE SECOND READING
WHEREAS, certain roads designated on the Atlases of Clermont County, Ohio, as township roads have never been opened as part of the township road system and other roads which my have been opened as part of the township road system have been maintained as a part of the Miami Township Road System for a period of more than 21 years, and
WHEREAS, these roads are not carried as a part of the township road system on the Engineer's certificate of township roads for which the township received distributions from the Gasoline Tax Fund, and
WHEREAS, said roads have been abandoned and have not been used by the general public for public road purposes for a period of more than 21 years, and
WHEREAS, the Board of County Commissioners have been petitioned by abutting property owner(s) to vacate a section of Catherine Alley (T-1131), pursuant to Section 5553.03, et. al. of the Ohio Revised Code, and have requested the Board of Trustees of Miami Township to adopt a Resolution supporting the road vacating request.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio by authority of Chapter 504 of the Ohio Revised Code, as follows:
SECTION 1: That the Miami Township Board of Trustees supports the vacating of a section of Catherine Alley (T-1131).
SECTION 2: The Board does hereby dispense with the requirement that this Resolution be read on two separate days, pursuant to Section 504.10 of the Ohio Revised Code, and authorizes the adoption of this Resolution upon its first reading.
SECTION 3: That the Fiscal Officer of Miami Township Trustees certify a copy of this Resolution to the Board of County Commissioners of Clermont County, Ohio, with the request to proceed immediately pursuant to Sections 5553.03, et. al., of the Ohio Revised Code to vacate said roads or portions thereof.
SECTION 4: That this Board hereby finds and determines that all
formal actions relative to the passage of this Resolution were taken
in an open meeting of this Board, and that all deliberations of this
Board and of its Committees, if any, which resulted in formal action,
were taken in meetings open to the public, in full compliance with
applicable legal requirements, including Section 121.22 of the Ohio
Revised Code.
SECTION 5: This Resolution shall take effect at the earliest period
allowed by law.

Effective: July 6, 2006
MR. TRACY seconded the motion to adopt the Resolution. On the roll call being called the vote resulted as follows:
