The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on August 1, 2006 with the following members present: Edwin H. Humphrey, Ken Tracy and Mary Makley Wolff.
MRS. WOLFF made a motion to adopt the following Resolution:
RESOLUTION DISPOSING OF SURPLUS PROPERTY AND AUTHORIZING THE DISPOSAL OF SURPLUS PROPERTY BY PRIVATE SALE, DISPENSING WITH THE SECOND READING
WHEREAS, the Board of Trustees (the "Board") has determined that they are the owner of property that is no longer of value and service to Miami Township; and
WHEREAS, the Board is empowered by Section 505.10 to dispose of surplus property by private sale if the fair market value of property to be sold is, in the opinion of the Board, two thousand five hundred dollars or less.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio by authority of Chapter 504 and Section 505.10 of the Ohio Revised Code, as follows:
SECTION 1: The Board determines that the surplus property listed on Exhibit A is no longer of value and service to Miami Township; further
SECTION 2: That the board finds the value of the surplus property to be $2,500 or less; further
SECTION 3: That Section 505.10 of the Ohio Revised Code authorizes the sale of surplus property with a value of $2,500 or less by private sale; further
SECTION 4: That the township administrator or designee shall proceed to sell the surplus property in accordance with ORC 505.10(A)(2)(a) by private sale at such time, place and manner, and at such price as the township administrator or his designee determines to be reasonable for any individual item or the total of all items; further
SECTION 5: That pursuant to ORC 505.10 (A)(7) any item that fails
to sell shall be deemed to be surplus property, obsolete or unfit for
township use and may be discarded or salvaged as the township
administrator or his designee so determines; further
SECTION 6: The Board does hereby dispense with the requirement that
this Resolution be read on two separate days, pursuant to Section
504.10 of the Ohio Revised Code, and authorizes the adoption of this
Resolution upon its first reading; further
SECTION 7: That this Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board and of its Committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code; further
SECTION 8: This Resolution shall take effect at the earliest period allowed by law.

Second Reading: dispensed with
Effective: August 31, 2006
MR. TRACY seconded the motion to adopt the Resolution. On the roll call being called the vote resulted as follows:
